Is it actually

Pedals and an “eBike” label do not decide what the device is. Its motor, throttle and speed capability do.

A throttle that stops providing motor power at 20 mph may fit California’s Class 2 definition—if the device also has fully operable pedals, a motor of 750 watts or less and meets the other requirements in CVC 312.5.

Before Your Child Rides

Do not rely on
the product name.

Check these five things

  • Find the permanent classification label.
  • Confirm the continuous motor rating is 750W or less.
  • Check whether it has a throttle.
  • Confirm the maximum assisted speed in each mode.
  • Look for app settings, unlocks or “off-road” modes that change speed.

Red flags when buying

  • Throttle advertised above 20 mph.
  • Claims such as “Class 2 unlocks to 35 mph.”
  • “For off-road use only” language on a street-riding product.
  • No clear motor rating or classification label.
  • The seller says pedals automatically make it an eBike.

21 mph matters.

If the throttle propels the device 21–30 mph on flat ground, it is not an eBike under California’s eBike definition. If it otherwise meets CVC 406, it is likely a moped—with different age, licensing, helmet, identification and roadway requirements.

What should
you call it?

Legal eBike

Fully operable pedals, no more than 750W, and motor assistance limited by Class 1, 2 or 3 rules.

Moped / Motorized Bicycle

A device capable of no more than 30 mph on level ground that meets the additional requirements of CVC 406. California DMV states riders must be at least 16, wear a helmet, obtain a special plate and hold an M1 or M2 license.

Pedal eMoto

A useful description for a high-powered, motorcycle-style device with pedals that exceeds eBike limits. Pedals do not determine its legal classification.

eMoto / Electric Motorcycle

A throttle-powered device exceeding moped limits—especially one capable of more than 30 mph—belongs in motorcycle or off-highway-vehicle territory, not the eBike class system. Street legality depends on the device’s equipment, registration eligibility and use.

How power arrives

Pedal assist vs. throttle

Pedal assist adds motor power while the rider pedals. A throttle can propel the bike without pedaling. That difference is central to California’s class definitions.

How assist feels

Cadence vs. torque sensor

A cadence sensor detects that the cranks are turning and switches assistance on. A torque sensor measures pedal effort and generally delivers power in proportion to how hard the rider pushes.

Where the motor sits

Hub vs. mid-drive

A hub motor drives a wheel directly. A mid-drive powers through the bicycle’s drivetrain, which can improve climbing response but also places more load on the chain, cassette and shifting system.

A commonly confused number

Assisted speed is not all speed

The class limit is where motor assistance must stop. A rider may travel faster from gravity or human effort; that does not mean the motor is permitted to keep assisting.

What carries the load

Passengers and cargo

Check the manufacturer’s total weight rating and approved seating—not just whether a passenger can physically fit. Added weight changes braking distance, balance, tire load and handling.

What keeps it rideable

Brakes, tires and drivetrain

Higher weight and speed accelerate wear. Check tire pressure and condition, brake-pad life, rotor condition, chain wear and fasteners on a regular schedule—and after any crash or hard impact.

Treat the battery
as a system.

Bike + battery + charger.

They are engineered to work together. Do not substitute a “universal” charger or an unapproved replacement battery.

Safer charging habits

  • Use only the charger supplied or recommended by the manufacturer.
  • Be present while charging; never charge while sleeping or away from home.
  • Unplug when charging is complete and follow the manufacturer’s instructions.
  • Stop using a battery that is swollen, cracked, leaking, unusually hot, hissing or producing odor or smoke.
  • Look for third-party certification by an accredited laboratory; UL 2849 covers the eBike electrical system and UL 2271 applies to light-electric-vehicle batteries.

Certification is not a guarantee against every failure, but it shows the applicable electrical system or battery was evaluated to a recognized safety standard.
